This includes 50 US states, District of Columbia, Puerto Rico only. The US territories are not covered under this definition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Food that is imported with inadequate Prior Notice is\nsubject to refusal and detention at the port of entry.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For Prior Notice, food includes all foods for human or\nanimal consumption, irrespective of intended use.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prior Notices are considered inadequate:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>When there is either no prior notice submitted,\nor <\/li><li>The information submitted in prior notice is\ninaccurate, or <\/li><li>The prior notice is not submitted in accordance\nwith required timeframes.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The requirement for prior notice is not based on the requirement of <a href=\"https:\/\/www.fdahelp.us\/fda-food-registration.html\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">FDA registration<\/a>. FDA registration is required for facilities that are engaged in manufacturing, processing, packing or holding of food for consumption in USA. Prior Notice is required for articles of food imported into US.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There are two online systems available that may be used to\nfile Prior Notices namely., FDA\u2019s PNSI and CBP\u2019s ABI\/ACS. For a prior notice\nsubmitted via CBP\u2019s ABI\/ACS, you may not submit prior notice more than 30\ncalendar days before the anticipated date of arrival. For a prior notice\nsubmitted via the FDA\u2019s PNSI, you may not submit prior notice more than 15\ncalendar days before the anticipated date of arrival.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The requirement of Prior Notice does not apply to:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Food for personal use that accompanies the\nindividual.<\/li><li>Home made food sent as personal gift to another\nindividual in US.<\/li><li>Food that is imported &amp; then exported and\ndoesn\u2019t not leave the port of arrival.<\/li><li>Meat and Poultry food products regulated\nexclusively by USDA.<\/li><li>Food brought in diplomatic bags.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Any person with knowledge of the required information may\nsubmit prior notice for an article of food being imported.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Timeframes for submitting Prior Notice:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For foods arriving by international mail \u2013 <\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>For foods arriving by road, 2 hours before\narrival; <\/li><li>For foods arriving by rail or by air, 4 hours\nbefore arrival; <\/li><li>For foods arriving by water, 8 hours before\narrival<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">For foods arriving by Express Couriers like\nFEDEX &#8211; before the food is sent<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em><a href=\"https:\/\/www.fdahelp.us\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Liberty Management Group LTD<\/a><\/em><strong><em>&nbsp; is one of the leading FDA consulting groups in the USA.
