FDA requires US and foreign facilities that manufacture,\nprocess, pack, or hold food<\/a> for\nhuman or animal consumption in the USA to register with FDA<\/a>.<\/p>\n\n\n\n

Important definitions:<\/p>\n\n\n\n

  1. Facility – any establishment, structure, or\nstructures under one ownership at one general physical location that\nmanufactures, processes, packs, or holds food for consumption in the USA. <\/li>
  2. Domestic facility – any facility located in the\nUSA, the District of Columbia, or the Commonwealth of Puerto Rico that\nmanufactures, processes, packs, or holds food for consumption in the USA.<\/li>
  3. Foreign facility – any facility other than a\ndomestic facility that manufactures\/processes, packs, or holds food for\nconsumption in the USA.<\/li>
  4. Manufacturing\/processing – making food from one\nor more ingredients, or synthesizing, preparing, treating, modifying or\nmanipulating food, including food crops or ingredients. <\/li>
  5. Holding – storage of food and includes\nactivities performed incidental to storage of a food. Holding facilities could\ninclude warehouses, cold storage facilities, storage silos, grain elevators,\nand liquid storage tanks.<\/li>
  6. Packaging – placing food into a container that\nis directly in contact with the food.<\/li>
  7. Packing – placing food into a container other\nthan packaging the food and includes re-packing and activities performed\nincidental to packing or re-packing a food.<\/li>
  8. Trade name – other names under which the\nfacility conducts business or is known by. <\/li>
  9. US Agent<\/a> – person\nresiding or maintaining a place of business in the USA and who is designated as\nagent by a foreign facility. <\/li>
  10. The US Agent acts as a communications link\nbetween FDA and the foreign facility for both emergency and routine\ncommunications. The US Agent will be the person FDA contacts when an emergency\noccurs, unless the registration specifies another emergency contact.<\/li>
  11. FDA will consider the US Agent the equivalent of\nthe registrant for purposes of sharing information and communications.<\/li>
  12. Registrant – the owner, operator, or agent in\ncharge of a facility that manufactures, processes, packs, or holds food for\nconsumption in the USA.<\/li><\/ol>\n\n\n\n
